It's not "are X or were X" but rather "are X or were [adverb] X". If you insert an adverb into an "are or were X" construction, the adverb is not bound to "were".
The difference is more obvious if you substitute "historically" with "commonly": "countries where Chinese characters are or were commonly used". In this sentence, "commonly" clearly applies to both "are" and "were".

You're correct. I note that the JE dictionaries favour transitive glosses (in the active voice), probably because the passive voice can sound awkward and is less helpful for translations. e.g. "このびんには2リットル入る" is better translated as "This bottle holds two litres" than as "Two litres can be held in this bottle". But I support the change. I've amended the "obtain" sense as well.
Added some more senses.
I don't think we need a separate sense for "break into".
I'll reindex the sentences if this is approved.

From what I understand, sense 4 seems "backwards" - the most common definitions of "contain", "hold", and "accommodate" are transitive, but "入る" is listed as intransitive. The examples I have seen other dictionaries use to explain this sense all seem to point to a passive definition, where the subject is the item being "contained". - it's pretty much 利権 + ビジネス, but the 直訳 "concession company" doesn't actually mean much to me
- the reference doesn't explain that well what it really means (assuming it's accurate - some of those "best answers" are off the mark.)
- AFAICT a "concessionaire" doesn't mean the same thing as a "company that deals with concessions". It's more an entity that's been granted a concession.
I'm not convinced it's needed, and I certainly think it needs a more informative gloss.

I think there's an issue with lumping in Meiji-era words with 8th century words, which would be what we're doing if we call them all 
[arch]. 現代日本語, modern Japanese, is generally defined to begin with the Meiji period. But it's not that I mind calling Meiji words 
"arch" - other dictionaries use "archaic" to mean "old-fashioned" and "obsolete" to mean words that are not in use at all. I think it's 
worthwhile to distinguish between modern Japanese and other older forms of the language.

I agree that the arch/obs distinction is unclear and that obs should be reserved for the category of words that Rene described.
While it's true that Meiji-era literature is still widely read, I think we should explore the option of extending the scope of the arch tag to include obsolete terms from this era.
The bakumatsu/Meiji cutoff is logical, but it can be difficult with the tools at our disposal to know whether a particular word was common at that time. Words don't just suddenly stop being used; it's a gradual process.
And even if a (now-obsolete) word *was* common in the Meiji era, is there an issue with describing it as "archaic"? Plenty of "archaic" words in English appear regularly in late 19th and early 20th century literature.

Those 幽霊文字 are ALL in kanjidic because they're in JIS X 0208 and now in Unicode. Despite them being mistakes, usually artifacts of bad data collection when the early JIS standards were being developed, they are now being used. They're not going to be deleted.
Some, like 妛, got an extra stroke because of a fold in the paper showing up in a photocopy as a line. One of my favourites is 彁, where the 弓 on the left came from a marginal scribble next to a 哥 (at least that's what a member of the JIS committee told me in 2000; the quoted WWW page says "「彊」などの誤写か。")  There's no great secret about these 幽霊文字; there's an appendix in JIS X 0208:1997 discussing them all.
I'm adding "phantom kanji" to the meanings of the known 幽霊文字 in kanjidic.
